Art. 1 Object

This contract establishes the conditions relating to the purchase and participation in the training courses organized by YouJazz S.r.l. and defines the services reserved for members.

Art. 2 Registration

Enrollment in the training courses organized by YouJazz S.r.l. can be done by online procedure through the website www.musixup.com. By selecting the chosen course you will be redirected to the web page containing all the information.

Registration and enrollment in any of YouJazz S.r.l.’s services are subject to acceptance of these Terms and Conditions, acknowledgement of the Privacy Policy and provision of consent to the processing of personal data.

Art. 3 Learning Materials

Enrollment in one of YouJazz S.r.l.’s training courses entitles the holder to access to educational materials (e.g. videos, images, pdfs, slides…). Access to the material is allowed for the entire period of registration on the site.

Art. 4 Intellectual and industrial property

YouJazz S.r.l. declares that it has acquired the rights of economic exploitation on all the educational material related to the training courses offered, in any format, published on its website and Facebook groups and/or distributed during the lessons, and to use any material covered by copyright in accordance with L. April 22, 1941 n. 633 and other applicable legislation in force.

The user is granted the ability to view the educational material and, where permitted, to download it, for the sole purpose of learning. Such material may not be reproduced for purposes other than educational purposes in relation to the course in question, remaining precluded (by way of example only) the right to disseminate, copy, sell, translate, communicate to the public and any use that is not private and exclusively educational, as well as any other action not expressly provided for and specifically agreed with YouJazz S.r.l. In case of violation, the Participant will be required to pay a penalty equal to the list price of the course attended, subject to further compensation for damages.

Adherence to this contract does not grant the user any rights to the trademarks (including those of third parties), content of any kind, or any other element on the YouJazz S.r.l. website on those related to it or otherwise used during the course. No logo, graphic element, sound or image may be used, copied or reproduced without the express permission of YouJazz S.r.l.

Art. 5 Obligations of YouJazz S.r.l.

YouJazz S.r.l. guarantees access to the services that are the subject of this contract to those who have correctly completed the registration and course purchase process for the duration of the contract. It is specified that in the event of cessation of activity, the contents may no longer be accessible.

YouJazz S.r.l. will make available to the Participant its own restricted area in which his or her personal data and further information related to the courses selected and purchased will be listed.

In the event that YouJazz Srl is partially or wholly acquired by other companies, the contents and data within it may be migrated.

Art. 6 Obligations of the user

The user undertakes not to use the website, and its services for purposes contrary to the law and this contract, or in ways that may impair its functionality and/or create interference with its use by other Users; he/she also undertakes to behave correctly and in a civil manner towards YouJazz S.r.l. personnel.

The user agrees to provide his personal data in a correct and truthful manner.

Art. 7 Changes to the contract
YouJazz S.r.l. may amend these Terms and Conditions at any time, for justified reasons, by notifying the interested parties on its website. In this case, the changes will be effective to the effects of law, without the need for specific and further approval and in any case after ten days from their publication.

Art. 8 Confidentiality

YouJazz S.r.l. undertakes to store and process the personal data of Users in accordance with the provisions of Legislative Decree No. 196 of June 30, 2003, ensuring compliance with the requirements therein, and to use the information only for the purposes indicated to Users and for which they have given specific consent, where necessary.

Art. 9 RefundIn accordance with Article 59 of the Consumer Code for the mode of sale/supply of audio/video streaming, the right of withdrawal/refund of consideration is expressly excluded. The User also agrees in accordance with Art. 50, paragraph 2, and Art. 51, paragraph 7. Art. 10 Third Party Websites The Service may provide, or third parties may provide, links or other access to other sites and resources on the Internet. YouJazz S.r.l. has no control over such sites and resources, and YouJazz S.r.l. is not responsible for and does not endorse such sites and resources. Any relationship you have with third parties found while using the Service is between you and the third party, and you agree that YouJazz is not responsible for any losses or claims you may have against such third parties. Art. 11 Social Networking Services You may enable or access the Service through various third-party online services, such as social media and social networking services like Facebook (“Social Networking Services”). To take advantage of this functionality and capability, we may ask you to authenticate, register, or access Social Networking Services on the websites of the respective providers. As part of such integration, the Social Network Services will provide us with access to certain information that you have provided to such Social Network Services and we will use, store and disclose such information in accordance with our Privacy Policy. 

However, please remember that the manner in which the Social Network Services use, store and disclose your information is governed solely by the policies of such third parties and YouJazz S.r.l. will have no responsibility or liability for the privacy practices or other actions of any third party site or service that may be enabled within the Service.

Art. 12 Applicable Law

This Agreement is governed by Italian law, to which reference is made for everything not expressly established.

Art. 13 Jurisdiction

For any dispute inherent in or arising out of this Agreement or its execution, the Court of Turin shall have exclusive jurisdiction, without prejudice to the Consumer’s Court where applicable.
